Am I Eligible for Expungement?
Expungement is restricted to only certain people charged with a crime. If you were arrested and not convicted, you can probably have your record expunged without much difficulty. However, if you were convicted, you can only have the record expunged if certain criteria are met.
You must meet one of the following criteria for expungement in Illinois:
- You were found not guilty or the charges were dismissed
- You were convicted of an expungement-eligible misdemeanor
- Sentenced to supervision
- It has been 5 years since your supervision was discharged
- You have not been charged with another crime
- You served a prison sentence for select misdemeanors
- It has been 5 years since your sentence or probation ended
- You have not been charged with another crime
- You received a pardon
- You were the victim of criminal identity theft
